TERMS AND CONDITIONS:
Article 1 – Scope
The General Terms and Conditions (“T&C’s”) apply to all services offered by Massimiliano Bulgheroni (“Massimiliano Bulgheroni”), such as somatic therapy sessions, coaching, plant medicine retreats (1:1 and occasional), and any material, content, and/or resources made available through massimilianobody.work (“the Website”).
By visiting the Website and/or making use of the Services provided by Massimiliano Bulgheroni, the Participant (“Participant”) or (“you”) agree to the applicability of these General Terms and Conditions.
Massimiliano Bulgheroni may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and available on the Website. Massimiliano Bulgheroni will announce any amendments to the General Terms and Conditions in advance by email.
Article 2 - Services
These T&C’s apply more specifically to the following Services provided by Massimiliano Bulgheroni:
Somatic Therapy Sessions
Coaching
Plant Medicine Retreats
1 to 1 sessions
Occasional workshops and events
Article 3 - Application
In order to use the Services, you may be required to complete an application and provide information about yourself through a form, such as your first & last name, your address, mailing address, and other personal information regarding your health & well-being. By filling out the form, you agree that the submitted information is accurate, correct, and up to date.
Once you have submitted the application form, you will receive an email from massimiliano.bulgheroni@gmail.com to confirm the receipt of your application. In case you like to make any changes in the application, please send them to: massimiliano.bulgheroni@gmail.com.
Article 4 - Payment and Confirmation
For all Services offered by Massimiliano Bulgheroni, all applicable prices are shown on the website. All payments must be made before the start of the Service and can be made by bank transfer upon receipt of invoice.
Your spot for the Plant Medicine Retreat is secured once a deposit payment of 300 euros or the full amount is received. The remaining balance of the Retreat price is due to Massimiliano Bulgheroni no later than six weeks prior to the start of the Retreat.
Any international bank charges from payments made via international transfers are the responsibility of the Participant.
All prices included on the Website are including VAT (BTW) unless explicitly stated otherwise.
You are always free to donate an extra amount to the agreed amount as a way to contribute to embodying more love on this planet.
Article 5 - Cancellation Retreat by Participant:
If you as Participant need to cancel your participation in a Retreat, the following refund policy applies:
i. Cancellation within 90 Days before the start date: Full refund, excluding the non-refundable deposit.
ii. Cancellation within 21 days before the start date: 50% of the remaining balance, excluding the non-refundable deposit.
iii. Cancellation closer than 21 days before the start date: No refund of the remaining balance or deposit.
Article 6 - Substitution by Participant
a. If you are unable to attend the retreat, you may substitute another person to take your place. Notify Massimiliano Bulgheroni of the substitution at least 21 days before the retreat start date.
b. The substitute Participant must be a fit for the Retreat based on the application and agrees to these T&C’s.
Article 7 - Cancellation Retreat by Massimiliano Bulgheroni:
a. Massimiliano Bulgheroni reserves the right to cancel or reschedule a retreat due to unforeseen circumstances, low enrollment, natural disasters, or other reasons.
b. In the event of a cancellation by Massimiliano Bulgheroni, participants can use the paid amount for a future retreat taking place within 2 years after the canceled retreat. If it is not an option to join a future retreat within this time frame, participants will receive a full refund of all payments made, including the non-refundable deposit. Massimiliano Bulgheroni cannot be held liable for any travel costs already incurred.
Article 8 - Intellectual Property Rights to Your Materials
Massimiliano Bulgheroni claims no intellectual property rights over the material you provide to Massimiliano Bulgheroni. You retain copyright and any other rights you may rightfully hold in any content that you submit through the Website or Services. Content you submit to Massimiliano Bulgheroni remains yours to the extent that you have any legal claims therein. You agree to hold Massimiliano Bulgheroni harmless from and against all claims, liabilities, and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you.
Article 9 - Intellectual Property Rights of Massimiliano Bulgheroni
The Website & Services contain Intellectual Property owned by Massimiliano Bulgheroni (“IP”), including trademarks, copyrights, proprietary information, and other intellectual property. You may not modify, publish, transmit, distribute, display, reproduce, or perform any of the Website or Services content or IP without prior written consent.
Massimiliano Bulgheroni will only take photos and videos during the performance of the Services after prior consent. This material will only be used to remember and integrate your experience with the Retreat group and only shared on the Website & Social Media for promotional purposes after prior consent.
Article 10 - Confidentiality
Both Massimiliano Bulgheroni - including any third party who supports Massimiliano Bulgheroni during Retreats - and the Participant are obliged to maintain confidentiality for all the confidential information received in the framework of the provided Services or from any other source. Information is considered confidential if this is communicated by the other party or if this results from the nature of the information.
Article 11 - Liability
Massimiliano Bulgheroni offers a loving, profound, safe & clear container for healing & transformation through prior exploratory call ahead of the Retreat, the submitted Health Screener Form by the Participant, and during the actual Retreat, for you to embody more love on this planet. There might be experienced third parties present during the Retreat to enhance this sense of safety, support, and trust, depending on the size of the retreat.
Attending a Retreat with Massimiliano Bulgheroni is at the Participant’s own risk and they are aware that the nature of their own experience is at their own full responsibility during the Retreat.
After the closing Ceremony of the Retreat, and after the integration call of the Medicine Journey, Massimiliano Bulgheroni is no longer obliged to provide aftercare, integration, further assistance, or support to the Participant.
In the event a Participant gets injured while participating in one of the Services, the Participant agrees to assume all financial obligations for any costs to be incurred. The Participant agrees that in no event is Massimiliano Bulgheroni held liable or responsible for any losses or liabilities arising out of participating in one of the programs.
Massimiliano Bulgheroni is not liable for any errors or omissions by its engaged third parties during the Retreat or one of the Services provided by Massimiliano Bulgheroni.
Massimiliano Bulgheroni advises arranging travel insurance prior to the start of the Retreat.
Article 12 - Governing Law and Dispute Settlement
The T&C’s are exclusively governed by British law.
Any disputes relating to the T&C’s or any of the Services provided by Massimiliano Bulgheroni are settled exclusively by the competent court in the United Kingdom.
